SnowClub Terms of Use
Version 1.0 · Effective date: [set at publish]
Welcome to SnowClub. These terms are the agreement between you and SnowGroup Digital Inc. ("SnowGroup", "we", "us") for using SnowClub at mysnowclub.com, its apps, and the member features that connect to SnowBus (snowbus.com). By creating an account or using SnowClub, you agree to these terms, our Privacy Policy, our Membership Terms and our Cookie Notice.
1. Who can join
You must be 16 or older to create an account. If you are under the age of majority where you live, you confirm a parent or guardian has agreed to these terms for you.
You can hold one personal account. Business accounts are covered in section 9.
2. Your account
Give us accurate details and keep them current. Keep your password private. You are responsible for activity on your account.
Tell us right away at the contact below if you think someone else has accessed your account.
3. Membership is free
Joining SnowClub is free. What membership includes is set out in the Membership Terms. If we ever offer a paid tier, it will come with its own terms and you will choose whether to join it.
4. Bookings, partners and who you buy from
SnowClub lets you find and book rides and mountain services through SnowBus and our partners: transport operators, rental shops, schools, guides, lodging and other businesses ("partners").
- When SnowBus sells the service (for example a scheduled SnowBus seat), SnowGroup is the seller. SnowBus booking terms apply.
- When a partner sells the service, the partner is the seller and is responsible for providing it. SnowGroup takes your payment on the partner's behalf through our checkout. The partner's own terms, cancellation rules and safety rules apply, and we show them before you pay where the partner provides them.
- Some partners confirm a request before your card is charged. If they decline or don't answer in time, the hold on your card is released.
- Prices, availability and descriptions come from partners and can change until your booking is confirmed.
Cancellations, changes and refunds follow the rules shown at checkout for that booking. Payments are processed by Stripe; we never store your full card number.
5. Member offers
Member prices and offers depend on the trip, the date and the partner. They are not guaranteed, can have limits, and can end. An offer applies only when it is shown at checkout for your booking.
6. Crews, clubs and community features
You can add the people you ride with and use group and club features as they become available. Some of these tools are still being built; we will label features that are not ready.
When you invite someone, only send invites to people who would want to hear from you.
7. Your content
You keep ownership of what you post (profile, photos, reviews, messages). You give SnowGroup a non-exclusive, worldwide, royalty-free licence to host, show and share it as needed to run SnowClub and, for public content, to show it within SnowClub and SnowBus. You can delete your content; copies may remain for a short time in backups.
Don't post anything you don't have the right to share, or anything unlawful, hateful, harassing, sexual, misleading or that exposes someone else's private information.
8. Acceptable use
Don't misuse SnowClub. That includes: scraping or bulk-collecting data; trying to get into accounts or systems that aren't yours; interfering with the service; reselling bookings or offers without permission; creating fake accounts, reviews or bookings; and using SnowClub to send spam.
9. Business and partner accounts
Businesses (vendors, operators, mountains, clubs) can add their business and manage it in the SnowClub workspace. A person who adds or manages a business confirms they are authorised to act for it.
Business accounts are also bound by the partner agreement or commercial terms we agree with that business (commission, fees, payouts, cancellation responsibilities). If those terms conflict with these, the partner agreement wins for business matters.
10. Our content and brands
SnowClub, SnowBus, SnowGroup, their logos and the site design belong to SnowGroup or its licensors. You may use SnowClub for your personal, non-commercial use under these terms. Nothing here gives you rights to our brands.
11. Disclaimers
Skiing, riding and mountain travel carry risk. Partners are independent businesses, not our employees or agents, and they are responsible for the services they provide, including safety.
SnowClub is provided "as is" and "as available". To the extent the law allows, we don't promise it will be uninterrupted or error-free, or that partner information is always complete or current.
12. Limitation of liability
To the extent the law allows, SnowGroup is not liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill. For any claim about a booking, our total liability is limited to the amount you paid through SnowClub for that booking. For any other claim, it is limited to CAD $100.
Some places don't allow these limits, so they may not apply to you. Nothing here limits rights you have under consumer protection law that cannot be waived.
13. Ending your account
You can close your account at any time from your settings or by contacting us. We can suspend or close an account that breaks these terms, harms other members or partners, or is inactive for a long period, and we will tell you when we reasonably can. Bookings already confirmed stay subject to their booking terms.
14. Changes
We may update these terms. If a change is material, we will tell you by email or in SnowClub before it takes effect. Using SnowClub after that date means you accept the updated terms.
15. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Disputes go to the courts of British Columbia, unless consumer law where you live gives you the right to use your local courts.
